  Along with wow factor we are looking at the basic elements of composition: patterns, texture, symmetry, asymmetry, depth of field, lines, curves,frames, contrast, color, viewpoint, depth, negative space, filled space, foreground, background, visual tension, shapes)

• Image Quality
  

  Although we live in a digital world, we value the tangible assets of printed photos

  Screen grabs from video are only allowed in Surfer Category when a RAW file does not exist. Screen grabs must be from a camera on a surfer’s board or person. Original video must be time stamped during contest dates and available upon request.RAW files must be available upon request for all other submissions.

NYSEA Cold-Shot Contest

The NYSEA Cold-Shot Challenge (the “Contest”) begins January 14th, 2019 9:00am Pacific Time (California) Time (“PT”) and ends on March 31, 2018 at 8:59pm PT (the “Contest Period”). Contest is sponsored by Clif Bar [1451 66th St Emeryville, CA] (“Sponsor”), and administered by NYSEA Productions Inc– [ 218 E. Park Ave, Long Beach, NY 11561 ] . These are the official rules (“Official Rules”).

1.Eligibility
Contest is open to amateur and professional photographers who are legal U.S residents, physically residing in the United States, and are the age of majority in their home state as of the start date of the Contest, and who have Internet access prior to the Contest start date, and who have physical access to beaches and coastline in the states of New Jersey, New York, Massachusetts, Maine, Rhode Island, North Carolina, Virginia, Delaware, and/or New Hampshire.  This Contest is void outside of the United States and wherever else restricted or prohibited by law. Employees, shareholders, officers, directors, agents, representatives of Sponsor or Administrator (collectively “the Releasees”), the legal, promotion and advertising agencies of Sponsor, and their immediate family members and those living in their household, and each person or entity connected with the production or administration of the Contest, and each parent company, affiliate, subsidiary, agent and representative of any aforementioned entity, are not eligible to enter.

2. Purpose
The purposes of the Contest is to showcase and capture the beauty and diversity of the Cape Hatteras, NC to Maine shoreline including the Great Lakes (the “Photo Territory”) and the surfers who love it.  Contestants may enter photos in three categories.

• Category 1:  Empty: Photos that DO NOT HAVE a surfer riding in or on the wave being photographed.
• Category 2: Surfer: Photos that HAVE a surfer riding in or on the wave being photographed.

3. How to Enter
There are three ways to enter your photo (your “Submission”) in the Contest, but all Contestants must be registered members of NYSEA.  Your Submission must conform to the Submission Guidelines outlined in these rules.

• To enter as a registered member of NYSEA, you can simply log in to your account and upload your  photo (your “Submission”) using the SUBMIT A PHOTO link.
• To register,  go to NYSEA.com and create an account.  You will be asked for your user name and email address.  Once your account is created, you may click on the SUBMIT A PHOTO link and follow the instructions.
• You may also simply click on the SUBMIT A PHOTO page and you will be prompted to enter your username and email address; you will receive an email containing your log-in credentials and a temporary password.
• No other methods of entry will be accepted. All Submissions uploaded by the end of the Submission Period that are complete and otherwise qualified will be eligible to win. Sponsor reserves the right to disqualify any Contestant it finds to be tampering with the entry process or the operation of the Contest or violating these Official Rules. Contestants discovered entering under several names will be disqualified. Any submission of robotic, automatic, or programmed entries, or any entries submitted through other unapproved methods are void. Sponsor reserves the right to disqualify false entries or entries suspected of being false or fraudulent. Sponsor is not responsible for incomplete, late, lost, delayed, damaged, misdirected, incomplete, void, corrupted, garbled, illegible, or unintelligible submissions and those Submissions are void and will not be accepted; nor is Sponsor responsible for any problems, bugs or malfunctions Contestants may encounter when seeking to enter their Submissions. Contestants are solely responsible for compliance with the Sponsor’s terms and conditions.
• By uploading the Submission, Selected Contestant agrees that the Submission conforms to the Submission Guidelines and that Sponsor, in its sole discretion, may remove Selected Contestant’s Submission and disqualify Selected Contestant from the Contest if they believe the Submission fails to conform to the Submission Guidelines
  

4. Submission Guidelines.

• 20 total submissions from each individual photographer regardless of category or region.
• Submissions cannot depict, and cannot itself, be in violation of any Local, State & CDC Guideline Laws at the time of the photo.
• All Submissions must be an original work of authorship created by the Contestant who submits the entry. Submissions may not contain any illegal, offensive or obscene subject matter and any such Submission shall be disqualified without notification to Contestant. Contestants may not use third party trademarks or trade dress in their Submission.  Contestants may not copy or otherwise plagiarize the Submission from any source, nor may the Submissions include third party copyrighted material. Sponsor is not responsible for legal protection or clearance of Submissions in any form. Contestant agrees to indemnify Sponsor against any and all claims from any third party for any use by Sponsor of Submission. If, in the sole discretion of Sponsor, your Submission constitutes copyright infringement, trademark infringement or otherwise violates the rights of any third party, the Submission will be disqualified and Contestant will have no recourse to be reconsidered. Evidence that Submissions are an original work of authorship within the meaning of U.S. Copyright law may be required by Sponsor at any time during or after the Contest Period, including evidence that any surfer featured in a Submission has provided his or her permission.  In no event may an individual in a Submission be represented by an agent. In addition, your Submission must follow these guidelines:
• Submissions must be in JPG format no larger than 8mp. If source/original image is larger than 10mp it must be presented upon request to verify it meets all rules/requirements listed in Submission Guidelines.
• All Photos must be taken within the contest begin and end date.
• All entries with surfers must show the surfer catching a wave by using his or her own two hands.  No jet ski assists or any other mechanical assistance may be used by the surfer to catch the subject wave.
• Please no watermarks.  The Submission will be posted with the username of the photographer.
• Submissions cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity;
• Submissions cannot use filters or excessive editing;
• Submissions cannot be taken outside the Photo Territory;
• Submissions cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;
• Submissions cannot be obscene or offensive, endorse any form of hate or hate group;
• Submissions cannot defame, misrepresent or contain disparaging remarks about Sponsor, or their products, or other people, products or companies;
• Submissions cannot contain trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind, except those of Sponsor, without permission;
• Submissions cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission;
• Submissions cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission;
• Submissions cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; and
• Submissions cannot depict, and cannot itself, be in violation of any law. Sponsor reserves the right to exclude any Submission that it believes doesn't meet the above criteria, at its sole discretion.Submissions generated by script, macro or other automated means are void. Released Parties (as defined below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Submissions; all of which will be void.In the event of a dispute as to any Submission, the authorized account holder of the email address used to register the NYSEA account and used to enter the Contest will be deemed to be the Contestant and must comply with these Official Rules. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each Selected Contestant may be required to show proof of being an authorized account holder.

5. Voting & Judging.
Judging will be completed in 2 rounds. Prior to the voting Sponsor will screen photos based upon appropriateness of Submission as outlined in Section 5 of these Official Rules, and under the judging criteria below.

6. Selection and Notification of “Selected Contestants.”  On or about April 20, 2019 Selected Contestants will be contacted by a representative of Sponsor using the information submitted during the entry process. All Selected Contestants will be required to respond as directed to the email notification within 72 hours of attempted notification. failure to respond timely to the notification may result in forfeiture of the prize and, in such case, Sponsor may selected a Contestant with the next highest score. Each Selected Contestant may also be sent an affidavit of eligibility / liability / publicity release (“Release”).  Unless restricted by law, each Selected Contestant will be required to complete and return the Release within the time period specified therein. An alternate Selected Contestant may be chosen, from among the remaining eligible Contest Contestants if a Selected Contestant: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; (iii) or cannot accept or receive the prize for any reason.

7. Prizes. Twelve Prizes will be awarded.  Contestants in each category (2 Photographers & 1 Surfer each) will receive a prize of $1500 - Winner, $750 -Second, $500 - Third, $250 - Fourth, payable by check.  Total retail value of prize: $9000.00.

No substitutions, except by Sponsor.    If for any reason, the prize as listed cannot be awarded, Sponsor will substitute a prize of equal or greater value

8. License. During the duration of the contest, By entering, Contestants are granting NYSEA and Sponsor and its affiliates a worldwide, royalty-free, perpetual, unrestricted, irrevocable and fully sub-licensable right and license to consider, display, re-post, disclose, use, re-use, reproduce, modify, digitize or enhance, adapt, change, publish, translate, create derivative works from, distribute, re-distribute, publicly perform and/or display Contestant’s Submission (in whole or in part) and/or incorporate all or part of the Submission in other works, all in any form, format, media or technology now known or later developed or invented for current and future Cold Shot Challenge promotion.  Contestants will not be paid for their Submissions, or for granting Sponsor any of these rights. Additionally, while Sponsor will seek to post the Submission in the form as provided at the time of entry, Contestants agree that due to technical limitations, Submission may be altered from its original form. Sponsor shall have no liability as to posting of Submissions. By entering the Contest, Contestants agree to waive all claims to and shall receive no royalties of any kind now or in the future from Sponsor for use of their Submission and represent and warrant that no other party is entitled to claim royalties from the use of the Submission as set forth in these Official Rules.  Contestants may not resell, assign or transfer any of their rights under these Official Rules.

9. Publicity. NYSEA and Sponsor reserves the right to use the Submissions to the Contest for publicity purposes prior to or after the Contest end date, in any media (including on websites, in social media, and in print media), and to use the name, likeness, and hometown name of any Contestant, including all or part of Submissions throughout the world, without any compensation or prior review unless specifically prohibited by law for current and future Cold Shot Challenge promotion.

10.Conditions. Contest is subject to these official rules. By participating, Contestants agree to be bound by these complete Official Rules, including Sponsor’s terms of use and privacy policy guidelines. Contestants agree that the decisions of Sponsor are final and binding; and agree to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law. Taxes, if any, are the sole responsibility of Selected Contestant, and Contestants will be issued an IRS Form 1099 for the ARV of any awarded prize.  This Contest is void where prohibited or restricted by law, and subject to applicable federal, state provincial and local laws. By accepting a prize, winner agrees to release Sponsor, its attorneys, affiliates, together with the respective directors, employees, officers, licensees, licensors and agents of each, including without limitation, their respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Contest from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of prize or participation in any prize-related activities. Sponsor reserves the right to disqualify any Contestant it finds to be tampering with the entry process or the operation of the Contest or violating these Official Rules. The Releasees shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest, and especially for taking pictures in an inherently dangerous environment such as the Atlantic ocean; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Contest, including these official rules.  Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest, and reserve the right, in its sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor’s control, corrupt the administration, security or proper play of the Contest. Sponsor may prohibit a Contestant from participating in the Contest or winning prize if, in its sole discretion, it determines such Contestant is attempting to undermine the legitimate operation of the Contest or undermine the purpose of the Content in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass third parties, any other players or Sponsor representatives. Use of any automated system to participate is strictly prohibited and will result in immediate disqualification. Disputes regarding these Official Rules and/or this Contest will be governed by the internal laws of the State of California in the United States. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction within the United States..

11. Privacy.  All personal information collected by Sponsor will be used for the administration of the Contest and in conjunction with these Official Rules. Please refer to Sponsor’s privacy policy located at https://www.clifbar.com/privacy and [nysea privacy link] for important information regarding the collection, use and disclosure of personal information by Sponsor.
